Social Security Fairness Act Becomes Law
The Social Security Fairness Act (H.R. 82) was signed into law by President Biden on January 5, 2025. This Act repealed the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO).
The WEP reduces the Social Security benefits of people who receive pensions based on public sector jobs that are not covered by Social Security, and the GPO reduces the Social Security survivor/spousal benefits of public sector employees that receive retirement benefits that were earned through employment that was not covered by Social Security. The Social Security Fairness Act is applicable to SSA benefits payable beginning January 2024.
The Social Security Fairness Act does not impact JRS benefits but it could increase Social Security benefits for some JRS retirees and survivors. JRS is unable to answer questions regarding Social Security benefits of the impact of the Social Security Fairness Act on those benefits.
